The Philippine Department of Energy(DOE), together with partner agencies are starting to formulate the Implementing Rules and Regulations (IRR) for the 2006 Biofuels Law. Prior to promulgation, the IRR will have to be posted on the DOE website and printed in 2 major newspapers.

The National Biofuels Board which is advising the DOE on the formulation of the IRR is comprised of: A Chairman: the Energy Secretary and members :Secretaries of the Department of Trade and Industry (DTI), Department of Science and Technology (DOST), Department of Agriculture (DA), Department of Finance (DOF), Department of Labor and Employment (DOLE), the Administrators of the Philippine Coconut Authority (PCA) and Sugar Regulatory Authority (SRA)

Under the recently passed Philippine Biofuels Law, the DOE is assigned to promulgate the IRR 3 months after approval of the Act by the President of the Philippines and with consultation with the NBB and the stakeholder agencies.

Key functions of the Executive Branches Are:

  1. Department of Finance - monitor the production and importation of biofuels through the Bureau of Internal Revenue and Bureau of Customs.
  2. Department of Labor - promote gainful livelihood opportunities and facilitate productive employment by ensuring workers’ access to productive resources and social protection coverage, especially in the countryside.
  3. Tariff Commission - to create and classify a tariff line for biofuels and biofuel-blends, in consideration of WTO and AFTA agreements.
  4. Local Government Units (LGUs) - shall assist the Department of Energy in monitoring the distribution, sale and use of biofuels and biofuel-blends.
  5. Department of Science and Technology - together with the Dept of Agriculture shall work together to identify and develop viable feedstock and technology for the production of biofuels.
  6. Department of Agriculture - is mandated to develop a national program for the production of crops, which shall be used as feedstock supply for biofuels. The agency must ensure the increased productivity and sustainable supply of the feedstock, and publish information on available and suitable areas where such crops may be cultivated and produced.
